WILL RESPONSIBLE GROWTH FOR NORTHCROSS APPEAL THE VERDICT IN ITS CASE AGAINST THE CITY OF AUSTIN AND LINCOLN? PUBLIC MEETING TONIGHT TO DISCUSS NEXT STEPS

RG4N To Rally Citizens To Keep Fighting. Who May Run For City Council from RG4N?

AUSTIN, Texas, Jan. 11, 2008 ‹ Responsible Growth for Northcross (RG4N), the residents and business owners calling for a community-oriented redevelopment of Northcross Mall without a Wal-Mart Supercenter, will host an urgent town
hall meeting tonight to discuss its legal options and opposition plans.

The RG4N meeting is scheduled for Friday at 7 p.m. at St. Louis Catholic Church at 7601 Burnet Road. The large gathering of citizens will meet in Wozniak Hall.

RG4N will rally future protests and opposition the Wal-Mart Supercenter at Northcross. It will also address the possibility of appealing its legal ruling, and the likely impact of its efforts on the city elections in May.

Specifically, RG4N will take action to force an amendment to the Big Box ordinance. The plan will be revealed at the meeting.

RG4N sued the City of Austin and Lincoln Property Company on June 28, 2007. The 200th Judicial District Court of Travis County, presided over by Judge Orlinda Naranjo, ruled against RG4N¹s claims on December 21, 2007. RG4N is considering an appeal.

In a separate, yet similar case, the Allandale Neighborhood Association (ANA) was denied its motion for summary judgment on November 8, 2007. ANA has announced that it will appeal its legal case.

The RG4N town hall comes one day after the Austin City Council added $260,000 to an existing outside counsel contract with Scott, Douglass & McConnico, LLP of Austin for a total contract amount of $684,000.

Prior to filing its lawsuit, RG4N repeatedly called upon the City of Austin and Lincoln Property Company to stop fighting the citizens of Austin and to not waste citizens' tax dollars on an unnecessary legal battle over a development that would cause irreparable harm to the surrounding area, if built.

About Responsible Growth for Northcross RG4N is a group of citizens from the Allandale, Brentwood, Crestview, North Shoal Creek, Rosedale and Wooten neighborhoods pushing for a mixed-use redevelopment of the Northcross area. The group is working to stop the inclusion of a Wal-Mart Supercenter in the Northcross redevelopment. RG4N's growth-oriented solution for Northcross Mall would preserve the character, diversity and quality of life of the Northcross-area neighborhoods. This solution was developed to address the needs and concerns expressed by Austin citizens, businesses and civic organizations while ensuring a successful, profitable endeavor for the developer.
