Gun-Free Zone

Not In My House

What you need to do to make your home or business a gun-free zone, plus Austin businesses opting out of open carry

Texas' new open carry handgun law went into effect Jan. 1, which means those with a license can openly carry their firearms in any place they have previously been able to carry concealed handguns.

To bar people from bringing a handgun into your home or business, two signs must be posted at each entrance: one regarding concealed handguns (a "30.06 sign," named for that section of code) and one regarding openly carried handguns (a "30.07 sign").

The exact language on these pages must appear on the sign(s), in English and in Spanish, "in contrasting colors with block letters at least one inch in height," and must be "displayed in a conspicuous manner clearly visible to the public at each entrance to the property."

Once you've posted the signs, it's your responsibility to ask those who have disregarded them to leave. As of Jan. 1, it's a Class C misdemeanor to carry open or concealed handguns on private property after receiving a warning, rising to a Class A if they were told verbally and remained on the premises. For more information, visit the Texas Department of Public Safety website FAQ page at www.txdps.state.tx.us/rsd/chl/faqs/index.htm.

Of course, the state isn't giving these signs away, which is why we've created PDFs that conform to the rule of law, and can be printed out on two 11x17 sheets of paper. Download the PDFs.

Below is a working list of businesses in town (local and beyond) that have said they will opt out of open carry. Former City Council candidate Ed Scruggs is compiling a list for Texas Gun Sense (www.fb.com/txgunsense). Find the Internet's crowdsourced list on Twitter (#TXgunfreebiz). And we'll continue to update this list. If you operate a gun-free business that's not on this list, let us know by email at news@austinchronicle.com.
